Terms of Service

Welcome to D4 Chess Club™ ("D4 Chess Club™", "the Service"), a chess training platform operated by Haven Command LLC, a California limited liability company ("Company", "we", "us"). By creating an account or using D4 Chess Club™, you agree to these Terms of Service. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use D4 Chess Club™. By registering, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions & Billing

D4 Chess Club™ offers free and paid subscription tiers. Paid plans are billed on a recurring basis (monthly or annually) via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

• You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial billing periods except where required by law.
• We reserve the right to change pricing with 30 days' notice to your registered email.
• Coin purchases are non-refundable once delivered to your account.

4. No Improvement Guarantee

D4 Chess Club™ provides tools, puzzles, analysis, and AI coaching to support your chess development. We do not guarantee any improvement in your chess rating, skill level, or competitive results. Chess improvement depends on many factors including individual effort, consistency, and innate ability. Results will vary. The Service is provided as a training aid only.

5. Acceptable Use

You agree not to:

• Use bots, automation, or cheating tools to manipulate your account or the platform
• Attempt to reverse engineer, scrape, or copy the Service, AI systems, or content
• Share your account credentials or allow others to use your account
• Upload or transmit harmful code, spam, or illegal content
• Harass, impersonate, or harm other users

6. Intellectual Property

All content on D4 Chess Club™ — including puzzles, AI coaching output, course content, designs, logos, and software — is owned by Haven Command LLC or licensed to us. You are granted a limited, non-exclusive, revocable license to use the Service for personal, non-commercial purposes. You may not reproduce, distribute, or create derivative works without our written permission.

7. AI & Third-Party Services

D4 Chess Club™ uses AI services including Groq (AI coaching), Stockfish (game analysis), and Roboflow (position scanning). AI-generated coaching and analysis are provided for educational purposes only and may not always be accurate. We are not responsible for decisions made based on AI output.

8. Disclaimers

The Service is provided "AS IS" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that the Service will be error-free or that defects will be corrected.

9. Limitation of Liability

To the fullest extent permitted by law, Haven Command LLC and its members shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising out of or related to your use of D4 Chess Club™, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, at our sole discretion, with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

11. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of D4 Chess Club™ after changes are posted constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved first through mediation in Fresno County, California, and thereafter through binding arbitration under the rules of the American Arbitration Association.
